Ordering and Payment

Overview
Once you have decided on a Kodiak Steel Homes® model, you can begin the process of having your materials fabricated and delivered to you by placing your order. This will form a contract between you and Kodiak Steel Homes, Inc. that spells out what you will receive, how much it will cost, and when and how you pay for it. Some of those details will depend on the the order status you choose. Kodiak Steel Homes kits can be ordered in two ways: (1) make and ship and (2) hold for permit.

Make and Ship Status
Unless it is canceled while on hold, every order must eventually reach make and ship status, but you can order your home that way from the beginning. A make and ship order authorizes us to fabricate and ship your materials as quickly as possible. Normally it takes between 6 and 8 weeks from the time an order enters make and ship status until we deliver the materials. Before we commit an order to this status, we require a signed contract or release from hold (see below) and a deposit of 25% of the total purchase price. You may pay this deposit by credit card, wire transfer or by personal check, business check, or money order drawn on a U.S. bank or recognized financial institution. You must pay the balance due on your order in two payments; the first one week prior to delivery and the final payment as a C.O.D. when the steel is delivered, and this payment must be presented to the delivery driver in the form of a bank cashier's check before he unstraps the load. No other form of C.O.D. payment will be accepted.

Hold for Permit Status
Some permit offices may require you to submit drawings to be approved before they will issue the necessary permits. In this case, you can place a hold for permit order (also called "permit hold"). For a permit hold order, we require a processing deposit of 10% of the total purchase price. You may pay this deposit by credit card, wire transfer or by personal check, business check, or money order drawn on a U.S. bank or recognized financial institution. As soon as we receive that deposit and your signed contract, we will immediately prepare and send you a set of permit drawings that are stamped by an engineer licensed in the state the home will be delivered (allow 10 days to two weeks for the drawings to arrive). These will be structural plans; we do not provide engineer-sealed mechanical (plumbing, electrical, etc.) or foundation plans. When you receive your permits and are ready to take delivery of your home, you can convert your order to make and ship status by sending us a written request to release your order for fabrication (by postal mail, e-mail or fax) and the additional 15% deposit. As soon as we have a deposit that totals 25% of the total purchase price, your written release, and a signed agreement for any price adjustments (see below), we will schedule your order for fabrication, and you can expect delivery in 6 to 8 weeks. You must pay the balance due on your order in two payments; the first one week prior to delivery and the final payment as a C.O.D. when the steel is delivered, and this payment must be presented to the delivery driver in the form of a bank cashier's check before he unstraps the load. No other form of C.O.D. payment will be accepted.

Order Status and Pricing
We base our pricing on our costs for raw commodities like steel and finished products like insulation. Obviously, since these costs can change, we cannot hold pricing indefinitely. Therefore, the total purchase price for any order will be fixed at our published rates on the date the order enters make and ship status. That means that if you place a make and ship order, your total will be the amount on the original contract. However, if you place a hold for permit order, your total price is not fixed. If, at the time you release your order from hold, our published price for your home model has changed, we will send you a change order to amend the original contract with the updated pricing. You must sign and return this agreement before we can convert your order to make and ship status. Historically, prices go up more often than down, but they do go down sometimes. In either case, your price will be based on the conditions that exist at the time we have to purchase the materials for your home, and our pricing will be publicly posted on our web site and through the price sheets we publish for all our customers.

Cancellations and Delays
One purpose of the fabrication and processing deposits is to defray expenses we incur when processing an order. In the case of a cancellation, these deposits are not refundable. Buyers must understand that in placing an order they are requesting that we purchase costly materials and fabricate them to the buyer's specifications. Once an order enters make and ship status, we start incurring substantial costs very quickly. Should a buyer request that an order be delayed after we have begun fabricating materials, we have the right to immediately invoice that buyer for all or any part of the full purchase price with that amount being due and payable immediately (see our terms and conditions of sale).

Sales and Excise Taxes
Most states impose a tax on merchandise, including our home kits (Alaska, Hawaii, Delaware, New Hampshire, Montana, and Oregon do not). There is a common misconception that Internet purchases are exempt from these taxes (sales or excise taxes). Unfortunately, that is not true. Mail order and Internet companies may not be obligated to collect the tax on merchandise they deliver to states where they have no physical presence (an office, local representative, etc.), but buyers still legally owe it. In practice, taxes are rarely paid on mail-order or online purchases of small items like books, clothing, and computers because states have no way to know these transactions took place. Houses are a different story. One of the first conditions for a "clear title" to real property is proof that all taxes are paid, including the sales tax for construction materials. Any number of typical occurences will cause your property's tax status to be examined -- loan applications, probate, reassessments, and more. In short, it is virtually impossible to avoid paying this tax, and trying could lead to costly penalties or worse.

Our Price - Plus Tax
Unlike many companies who deliver products all over the country from a central location, Kodiak Steel Homes, Inc. is registered as a "foreign corporation" in sales-tax states (except Arkansas where we are located). This means that we are legally obligated to collect applicable local taxes. All the states can (and do) audit our books to make sure we fulfill this duty. Some people have asked why we do not include taxes in our quotes. There are a couple of reasons. The simplest is that the tax is not part of our price. We have no control over it, and we do not benefit from it (collecting it costs us money). Just like your grocery store and every other business you trade with, we show you what we charge for our products, and we tell you that we will add the tax required by your local government when and if you buy something. Secondly, we do not show tax at the time we issue a quote because we do not know what it is. There are more than 3600 counties and parishes in the United States, and every one of them can have a different tax rate that can change at any time. We do not have the resources to confirm those rates every time someone wants a quote, so we only do it when we have to, after someone buys a home.
